Foodia Terms of Use

These terms are the agreement between you and whoever develops Foodia. By creating an account or using the application, you accept them.

They are written to be understood. If anything isn't clear, write to us before you subscribe: gus.morales@me.com

Who provides the service

Gustavo Morales, a natural person, domiciled in Chile. Contact: gus.morales@me.com

What Foodia is

Foodia estimates the calories and macronutrients of a meal from a photo or from a written or dictated description. It also lets you record your weight, your body measurements, your hydration and your goals, view your history and share your progress with a nutrition professional if you choose to.

The analysis is performed by an artificial intelligence model running on our servers, not on your phone. That means Foodia needs an internet connection to analyse a meal. What you have already logged can be consulted offline.

Estimates are estimates

This is the most important part of this document.

Foodia estimates. A model looking at a photo cannot know the exact grams on a served plate, how much oil went into a stir-fry or which cut a piece of meat is. A nutritionist looking at the same photo couldn't either. The figures Foodia gives you are a useful approximation for keeping a record, not a measurement.

That is why everything is editable: you can correct the grams of each food, replace one that was misidentified, add any that are missing or remove any that don't belong.

Foodia is not a health service, does not give medical or nutritional advice, and does not replace a professional. Do not use it to make clinical decisions, to treat an illness or to manage a condition that requires professional supervision — diabetes, kidney disease, an eating disorder, a pregnancy. If you have questions about your diet or your health, consult a doctor or a nutritionist.

Your account

To use Foodia you need an account, created with Sign in with Apple. We do not handle passwords: authentication is Apple's.

Your account is yours and personal. You are responsible for what is done from it and for the device where the session is open.

You can delete your account whenever you want from Profile → Delete my account. The deletion is immediate and final: your meals, your photos, your measurements, your profile and your sign-in identity are erased. There is no way to recover it. The details are in the privacy policy.

Deleting the account does not cancel your subscription: the subscription is managed by Apple and must be cancelled separately. We explain how below.

Minimum age

Foodia is rated for people over 13 and is not for children. Keeping a daily record of calories is not a neutral activity at any age: it can reinforce risky behaviour in someone who is still forming their relationship with food.

If you are between 13 and 18, use it only with the knowledge of your mother, your father or whoever cares for you, and preferably alongside a professional. If you are not at least 13, do not create an account.

Foodia Pro

What it includes

Foodia works with a subscription called Foodia Pro, which gives access to meal analysis and to all the features of the application.

Every new account starts with a 5-day free trial that starts with your first meal analysis. Nothing is charged during the trial and you do not need to subscribe to use it.

How many analyses you can run

Each meal analysis has a real cost for us, because it is processed by an artificial intelligence model we pay for by usage. To keep the service sustainable and to prevent automated use, there is a daily analysis cap:

Only successful analyses count: one that fails or finds no food does not count against the cap. The cap is counted per day and resets every day. It does not accumulate: analyses you didn't use today do not carry over to tomorrow.

These numbers may change. If we lower them, we will tell you inside the application before the change affects you, and you will be able to cancel the subscription if it doesn't suit you. The rest of the application — consulting your history, editing meals, recording weight, measurements and water — has no cap.

Anything that is not analysis by photo or by description does not consume the cap.

Prices and renewal

The subscription is offered in two plans:

The price you pay is always shown in your currency inside the application, before you confirm the purchase. It may differ from the reference price due to exchange rates and the taxes in your country.

The subscription is auto-renewing: it renews on its own at the end of each period and is charged to the payment method on your Apple account, unless you cancel at least 24 hours before the current period ends.

How to cancel

From the application, under Profile → Subscription → Manage. Also from your iPhone under Settings → your name → Subscriptions.

Cancelling stops future renewals. You keep access until the end of the period you already paid for; we do not charge or refund proportionally.

Payments and refunds

The purchase is processed by Apple, through the App Store's in-app purchase system. We do not see or store your payment details.

That is why refunds are also handled by Apple, according to its policies. They are requested at https://reportaproblem.apple.com. If you believe there was a mistake on our side, write to us and we will help you raise it, but the final decision is Apple's.

If you are a consumer in Chile, this does not affect the rights granted to you by Law No. 19,496 on the protection of consumer rights.

How you may use Foodia

Foodia is for your personal use. By using it, you agree not to:

• Use it to provide health services to third parties by passing it off as a diagnosis or a prescription.
• Access the application or our servers by means other than the official application: scripts, automations, modified clients or reverse engineering of the protocol.
• Attempt to bypass the analysis caps, create accounts in bulk to evade them or share your account to split the quota.
• Upload photos of people without their consent, illegal content or content unrelated to food.
• Attempt to breach the security of the service or access other people's data.

If we detect such use, we may suspend or close the account. Where reasonable we will warn you first and give you the chance to explain.

Your content

The photos you upload and what you log remain yours. We do not publish them, we do not sell them and we do not use them to train artificial intelligence models.

You give us permission to process them for the sole purpose of providing you the service: sending them to the model that performs the analysis, storing them in your account and showing them to you. That permission ends when you delete the content or your account.

If you share your progress with a nutrition professional, you grant that access and you can revoke it whenever you want from the application.

Sharing with a professional

Foodia lets you give a nutrition professional access to your log. You initiate that access, it reaches only what the application states at the time it is granted, and you can cut it off at any time.

The relationship between you and that professional is yours. Foodia is the tool through which you share information: we do not verify their credentials and we are not responsible for their guidance.

Service availability

We work to keep Foodia always available, but it is an online service and may have interruptions due to maintenance, failures or problems with third parties we depend on.

We may modify, suspend or discontinue features. If we discontinue the application or a feature you are paying for, we will give you reasonable notice and you will be able to export your data and cancel.

Liability

Foodia is provided as is. To the extent permitted by law, we are not liable for decisions you make based on its estimates, nor for indirect damages.

Nothing above limits our liability for wilful misconduct or gross negligence, nor the non-waivable rights Chilean law gives you as a consumer.

Changes to these terms

If we change something significant — prices, caps, what the subscription includes — we will tell you inside the application or by email before the change affects you, and we will update the date in the header.

Continuing to use Foodia after a change means you accept it. If you do not accept it, you can cancel the subscription and delete your account.

Governing law

These terms are governed by the law of Chile. Any dispute is submitted to the competent courts of Chile, without prejudice to the rights that correspond to you as a consumer and to the possibility of complaining to SERNAC.

Privacy

What data we collect, what for and who we share it with is in the privacy policy, which forms part of these terms.
